Service Provider

The service provider is an individual entrepreneur Povorina Ekaterina Valerievna, acting on the basis of a certificate of state registration of an individual as an individual entrepreneur 2224000000086716, issued by the State Registration Service of Ukraine on February 6, 2013, (TIN 3074002800, registration address — 49127, Ukraine, g Dnipro, 32 Nemirovicha-Danchenko St., apt. 18)

User

A user is any individual or legal entity that has confirmed its consent to conclude this Agreement by accepting all its terms and conditions and has placed an order to use the virtual platform https://forforce.team/ (hereinafter — platform).

Subject of the contract

The Provider undertakes to provide the User with a set of services for the provision of the virtual platform https://forforce.team/ for use, and the User undertakes to pay the appropriate fee for this and comply with the terms of use of the platform.

Payment

The cost of services is indicated on the site https://forforce.team/ , excluding VAT.
The terms of service may include a free trial period.
The services may be changed by the Service Provider unilaterally by changing the information on the site.
Payment for services can be made by the user through the payment module or in another way, separately agreed by the parties.
The service provider provides settlement documents based on a separate user request.
At the request of the user and on the basis of mutual consent, the Service Provider provides additional services (changing the functional features of the platform, changing the interface, etc.). Such additional services and other conditions for their provision are agreed by the Parties separately.

Procedure for the provision of services

The service provider is obliged to provide the user with a platform with functionality as described on the website https://forforce.team/.
The Service Provider has the right to terminate the User's access to the Platform if the User fails to make the mandatory payment or in the event of a gross violation of the terms of use of the Platform by the User. In this case, the user account data is stored for 90 calendar days, or immediately deleted at the request of the Client. If, after this period, the User has not made the mandatory payment or has not stopped violating the terms of use of the platform, the Service Provider has the right to delete the user's account.
The Service Provider has the right to suspend the user's access to the platform or its individual elements in order to carry out technical work with prior notification of the user of such work at least 24 hours before the start of scheduled work, or without prior notice in case of emergency work.
The Service Provider has the right, on its own initiative, to make changes to the functionality of the platform without changing its main purpose and functionality.

Rights, obligations and liability of the Service Provider

The service provider is obliged to maintain the normal operation of the platform for the entire time for which it is provided for use, except for unforeseen circumstances beyond the will of the service provider.
The service provider is obliged to immediately notify the user of unauthorized access to user data on the platform https://forforce.team/ or attempted such access.
The Service Provider does not acquire any rights to the information in the user's account and does not use the personal information contained in the user's account, except for the use of such data based on the user's separate consent.
The Service Provider has the right to involve third parties in the support of the https://forforce.team/ platform and is responsible to the User for the actions of such third parties as for their own.
The Service Provider is not liable to the User for any losses, damages, losses that were associated with the use or inability to use the platform.

Rights, duties and responsibilities of the User

The user has the right to an adequate level of services provided and to receive sufficient and timely technical support for the operation of the platform.
When concluding this Agreement, the User is obliged to provide the Service Provider with truthful information about himself, his business activities and other information that may be required
Service provider. In case of providing false information, the Service Provider reserves the right to terminate the user's access to the platform at any time.
The user is obliged not to use the platform for purposes other than the implementation of their legitimate business activities.
The user is responsible for the safety of his password, login, other platform access identifiers, confidential information and personal data entered into the platforms.
The user may not grant the use of his access to the platform to other persons who are not involved in the economic activities of the user.
The User is obliged not to use the program code or any part of it in any way other than as provided for in this Agreement, not to disclose or use algorithms or any other intellectual property objects that are part of the platform, and not to change the platform interface, modify the platform, not publish and do not copy the code or part of it, intellectual property objects that are parts of the platform.
The user is obliged to comply with the technical restrictions established in relation to the platform.
Before using the platform, the User is obliged to familiarize himself with this Agreement, other rules for using the platform, privacy policy, technical limitations of the platform, and familiarize all persons involved in using the platform with these resources.
The User has the right to a refund of the paid funds and to refuse to provide the service or, upon request, to eliminate deficiencies in the process of providing the service free of charge in case of inconsistency of the service provided with its description or in case of impossibility to provide the service due to the fault of the Service Provider within 1 (one) month from the start of the service.

Privacy Policy

The Service Provider undertakes to maintain the confidentiality of the information that it received in the process of providing services to the User. Confidential information means any data received by the Service Provider from the user as part of the implementation of this Agreement. Disclosure of such data may occur by the Service Provider only for the purpose of providing services, or on the basis of a separate agreement of the user.
The Service Provider undertakes not to use any personal data that he received in connection with the provision of services to the User, except for the use that is necessary for the provision of services.
The User is obliged to maintain the confidentiality of all information that became known to him in the process of receiving services from the Service Provider.

The term of this Agreement and the termination of the provision of services

This Agreement may be terminated unilaterally by the Service Provider in case of a gross violation of the terms of this Agreement by the user, or in the event of a systematic (more than 2 times) delay in payment for services by the user, or in case of impossibility of further provision of the service. If it is impossible to continue to provide the service, the Service Provider is obliged to notify the termination of this Agreement no later than 1 month before the date of such termination and take all possible actions to transfer the information contained in the User's account to the User.
In case of early termination of the provision services due to the fault of the Service Provider, the latter returns to the User the overpaid funds minus the payment for the actually provided services.
The Client may terminate this Agreement unilaterally by deleting the account and deleting the content. In this case, the funds paid for future periods of use will not be returned to the Client.
The Service Provider has the right to delete all information in the user's account 90 calendar days after the termination of the service.

Changing the terms of this Agreement

The Service Provider has the right to change the terms of this Agreement, the price of the service, the scope of the services provided, the configuration and functional features of the platform unilaterally, and notifies the Client about it.
